1. Agreement to These Terms

These Terms and Conditions ("Terms") are a binding agreement between you and Discovery School of Mesquite ("Discovery School," "we," "us") governing your use of www.discoveryschool.info, our parent portal, and our online forms (together, the "Services"). By using the Services you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and Accounts

The Services are intended for adults 18 or older. You are responsible for keeping your portal credentials confidential and for all activity under your account. We may suspend or terminate access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms, threatens the safety of children, families, or staff, or interferes with the operation of the Services.

3. No Enrollment Guarantee

Content on the Services is provided for general information and may change without notice. Submitting a tour request, enrollment packet, or other form does not create an enrollment agreement, reserve a place, or guarantee availability. Enrollment occurs only through our in-person enrollment process, is subject to availability and licensing requirements, and is governed by the Parent Handbook and signed enrollment documents, which control over anything on this website.

4. Acceptable Use

You agree not to: violate any law; submit false or misleading information; attempt to access another family's information; probe, scan, or test the security of the Services; introduce malicious code; scrape or harvest content or personal information; or copy, download, or reuse photographs of children appearing on the Services for any purpose. We may investigate and refer violations to law enforcement.

5. Intellectual Property

The Services and all content we create — text, images, logos, graphics, design, and software — are owned by or licensed to Discovery School and protected by law. We grant you a limited, revocable, non-transferable license to view the Services for personal, non-commercial purposes. All other rights are reserved. Our name and logo may not be used without our prior written permission.

6. Content You Submit

By submitting content through the Services (form entries, uploaded documents, photos, messages, reviews, testimonials), you grant Discovery School a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content as needed to operate the school and the Services, and — for testimonials and reviews you volunteer — to use in our marketing with attribution by first name. You represent that you have the right to submit what you upload.

7. Third-Party Services

The Services may link to or embed third-party sites and services (for example Facebook, Instagram, WhatsApp, Google Maps, payment processors). We do not control and are not responsible for them; your use of them is at your own risk and governed by their terms.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW. Nothing on the Services is professional, medical, educational, or legal advice.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DISCOVERY SCHOOL AND ITS OWNERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITS APPLY TO USE OF THE WEBSITE AND PORTAL ONLY; THEY DO NOT LIMIT ANY LIABILITY THAT CANNOT BE LIMITED UNDER TEXAS LAW, AND THEY DO NOT APPLY TO IN-PERSON CHILD CARE SERVICES, WHICH ARE GOVERNED BY YOUR ENROLLMENT AGREEMENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless Discovery School and its owners, directors, employees, and agents from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms, or content you submit.

11. Dispute Resolution — Arbitration and Class Waiver

Except for small-claims matters and requests for injunctive relief, any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Dallas County, Texas. You and Discovery School each waive the right to a jury trial and to participate in a class, collective, or representative action. Any claim must be filed within one (1) year after it arises, to the extent permitted by law. You may opt out of this arbitration provision by written notice to us within 30 days of first accepting these Terms.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to Section 11, exclusive venue lies in the state or federal courts of Dallas County, Texas.

13. Changes; Severability; Entire Agreement

We may modify these Terms at any time by posting the updated version with a new Effective Date; changes apply from posting, and continued use constitutes acceptance. If any provision is held unenforceable, the remainder stays in effect, and the provision will be enforced to the maximum extent permitted. These Terms and the policies they reference are the entire agreement regarding the Services.
